1. Acceptance of Terms

By creating an account or using our services, you agree to:

Service availability

• •Services are provided "as is" and "as available"
• •We strive for 99.9% uptime but cannot guarantee 100% availability
• •Scheduled maintenance may be required with advance notice
• •Force majeure events (natural disasters, etc.) are beyond our control

3. Customer Responsibilities

Provide accurate information

• •Truthful, accurate, and current account information
• •Prompt update of any changes to your information

Secure your account

• •Keep your password confidential
• •Notify us immediately of unauthorized access
• •Use strong, unique passwords

Comply with laws

• •Follow all applicable Indian and international laws
• •Respect intellectual property rights
• •Not engage in fraudulent activities

Use services responsibly

• •Not exceed resource limits of your plan
• •Not attempt to circumvent usage restrictions
• •Not resell services unless on a reseller plan

4. Acceptable Use Policy

You agree NOT to:

Illegal activities

• •Distribute malware, viruses, or harmful code
• •Engage in phishing or fraud
• •Violate any laws or regulations

Intellectual property violations

• •Host copyrighted content without permission
• •Distribute counterfeit goods
• •Infringe on trademarks or patents

Abuse of resources

• •Exceed storage or bandwidth limits
• •Run resource-intensive scripts affecting other users
• •Use hosting for crypto mining or similar activities

Spam and unsolicited communications

• •Send unsolicited bulk email (spam)
• •Harvest email addresses from websites
• •Use our services to distribute spam

Security violations

• •Attempt to access others' accounts or data
• •Probe or scan network vulnerabilities
• •Interfere with service operation

Adult content (unless permitted)

• •Host adult content on plans that prohibit it
• •Distribute illegal adult content
• •Violate obscenity laws

5. Payment & Billing

Billing cycle

• •Monthly plans billed monthly
• •Annual plans billed annually (save 17%)
• •Renewal at same rate as signup (no price hikes)

Payment methods

• •Credit/Debit cards (Visa, Mastercard, RuPay)
• •UPI (all major apps)
• •Net banking
• •Wallets (Paytm, PhonePe, Amazon Pay)

Late payments

• •7-day grace period for payment
• •15-day suspension for non-payment
• •30-day account termination for continued non-payment
• •₹50 late fee after 7 days

Refunds

• •30-day money-back guarantee on new accounts
• •Prorated refunds for annual plans (within 30 days)
• •No refunds after 30 days except for service failures

6. Cancellation & Termination

You may cancel

• •At any time through your control panel
• •Effective at end of current billing period
• •No cancellation fees
• •Refund policy applies

We may terminate

• •For violation of these terms
• •For non-payment after 30 days
• •For abuse of resources or AUP violations
• •With 30-day notice for policy changes

Upon termination

• •Data retained for 30 days then deleted
• •Domain registration transferred or released
• •No refund for partial months

7. Service Guarantees

Uptime guarantee

• •99.9% uptime guarantee
• •Service credits if uptime falls below 99.9%
• •Calculated monthly
• •Excludes scheduled maintenance and force majeure

Support response

• •Critical issues: 30-minute response (24/7)
• •High priority: 1-hour response
• •Medium priority: 4-hour response
• •Low priority: 12-hour response

Backup guarantee

• •Daily backups for all plans
• •7–30 day retention depending on plan
• •One-click restore available
• •No guarantee of backup integrity (customer responsible for backups)

8. Limitation of Liability

HostCloud liability is limited to the amount paid for services in the last 3 months, plus service credits for uptime failures.

No liability for

• •Lost data or business
• •Lost profits or revenue
• •Third-party actions or failures
• •Force majeure events

The total liability of HostCloud under any circumstance is limited to the amount you paid for services in the 3 months preceding the claim.

9. Intellectual Property

HostCloud retains ownership of

• •Infrastructure and technology
• •Website design and content
• •Brand names and trademarks
• •Software and tools provided

You retain ownership of

• •Your website content
• •Your domain names
• •Your data and databases
• •Your intellectual property

License to HostCloud

• •You grant us license to host, display, and transmit your content
• •You represent you own or have rights to all content you host
• •You indemnify us for claims regarding your content

10. Dispute Resolution

Governing law: these terms are governed by the laws of Maharashtra, India.

Dispute resolution

1. 1.Informal negotiation (30 days)
2. 2.Mediation (mutually agreed mediator)
3. 3.Arbitration (Pune, India)
4. 4.Court (civil court in Pune, Maharashtra)

Class action waiver: you agree to resolve disputes individually, not as part of a class action.

11. Modifications to Terms

• •Assignment: you may not assign your account without our consent. We may assign our rights without restriction.
• •Force majeure: we are not liable for failures due to circumstances beyond our control.
